On administrative liability for concealing the goods transported through the customs border of the Republic of Belarus from the customs inspection
Pursuant to this Decree, in case of concealment from the customs inspection of the goods transported through the border to a sum not exceeding 40 ‘ base values,’ the vehicles equipped with specially arranged hiding-places shall not be subject to mandatory confiscation, as it has been stipulated up to now.
Confiscation of the transport vehicles, which served as a tool for concealment from the customs inspection of such goods, shall be applied following the court’s decision that takes account of the nature of the law violation committed and the evidence of the carrier’s fault.
Thus, the cases, when individual passengers transported products and other goods hidden from the customs inspection without the carriers’ knowing about it and when mandatory confiscation was applied not only to illegally transported goods but also to the carriers’ transport vehicles, will no longer be permitted.
The Decree has been issued to protect the legitimate rights and interests of citizens and organizations, including international carriers, and to apply administrative penalty for concealment from the customs inspection of the goods transported through the customs border of the Republic of Belarus, taking account of the nature and consequences of the law violations committed.
